Refund Policy

The provisions of this article apply only to customers who, in their capacity as consumers, purchase items online from Velvet. The customer has the right to return the goods within a period of 14 calendar days without providing reasons. The return period expires 14 calendar days after the day on which the customer or a third party designated by the customer, who is not the carrier, physically takes possession of the goods. The direct costs of returning the goods are the responsibility of the customer. To exercise the return, the customer must notify their return via email to webshop@velvetstore.be. The customer can use the attached return form for this purpose, but it is not mandatory. To comply with the return period, the customer must send their notice regarding the exercise of the right of withdrawal before the return period expires. The customer must return the goods no later than 14 calendar days after receiving the goods, to Vrijheid 106A, 2320 Hoogstraten. The customer is on time if they return the goods before the 14 calendar days period expires. The customer is requested to return the items in their original condition and packaging, with all accessories and instructions included. If the returned product has decreased in value in any way, Velvet reserves the right to hold the customer liable and demand compensation for any decrease in the value of the goods resulting from the use of the goods by the customer beyond what is necessary to determine the nature, characteristics, and functioning of the goods. All returned items are carefully examined, with the assumption that the consumer may only inspect the item as they would in a store. Returned items may be tried on but must not be used. If an item has decreased in value due to the customer's use, this will be charged to the customer. If the customer returns the agreement, Velvet will refund all payments received from the customer up to that point within a maximum of 5 calendar days after Velvet has received the goods back. Velvet will refund the customer using the same payment method used for the original transaction, unless the customer expressly agrees otherwise; in any case, the customer will not be charged any fees for such a refund.

Delivery and Execution of the Agreement 

After ordering, Velvet prepares the goods for shipment. If goods are ordered before 11 am (GMT+1), delivery can be expected within 2 working days. Items ordered through this webshop are delivered throughout Europe by Bpost. Shipping costs for purchases under €60 are charged at €6. Deliveries are free for orders over €60. Additionally, customers can choose to pick up the goods for free in the store. Any visible damage or qualitative deficiency in an item or other deficiency in the delivery must be reported to Velvet immediately by the customer. The risk of loss or damage passes to the customer from the moment they (or a third party designated by them, who is not the carrier) physically takes possession of the goods. However, the risk already passes to the customer upon delivery to the carrier if the carrier has been instructed by the customer to transport the goods, and this choice was not offered by Velvet.

The data controller, BV Velvet Store, complies with the Belgian law of December 8, 1992, regarding the protection of private life in the processing of personal data. The personal data provided by you will only be used for the following purposes: the execution of the concluded agreement, processing the order, sending newsletters, advertising, and/or marketing purposes. You have a legal right to access and correct your personal data. With proof of identity (copy of ID card), you can request, free of charge, a written communication of your personal data from BV Velvet Store, Vrijheid 106A, 2320 Hoogstraten, webshop@velvetstore.be. If necessary, you can also request the correction of data that is incorrect or incomplete. We treat your data as confidential information and will not disclose, rent, or sell it to third parties. The customer is responsible for keeping their login details confidential. Your password is stored encrypted; Velvet does not have access to your password. Velvet keeps anonymous visitor statistics online to see which pages of the website are visited to what extent. Article 1: General Provisions

The e-commerce website of Velvet Store, a BV with registered office at Vrijheid 106A, 2320 Hoogstraten, VAT BE 0675565903, RPR of Antwerp, division Turnhout, (hereinafter "Velvet"), offers its customers the opportunity to purchase products from its online store. These General Terms and Conditions ("Conditions") apply to every order placed by a visitor to this e-commerce website ("Customer"). By placing an order through Velvet's webshop, the Customer expressly accepts these Conditions, agreeing to their applicability, excluding all other conditions. Additional conditions of the Customer are excluded unless accepted in writing and expressly by Velvet.

Article 2: Price

All prices are in EURO, always including VAT and all other taxes or charges to be borne by the Customer. If delivery, reservation, or administrative costs are charged, this will be separately mentioned. The price quote refers exclusively to the items as described in words. The accompanying photos are decorative and may contain elements not included in the price.

Article 3: Offer

Despite the careful compilation of the online catalog and e-commerce website, the information provided may be incomplete, contain material errors, or be outdated. Obvious mistakes or errors in the offer do not bind Velvet. Velvet is only bound to a reasonable effort regarding the accuracy and completeness of the information provided. Velvet is not liable in case of obvious material errors, typographical, or printing errors. If the Customer has specific questions about, for example, sizes, color, availability, delivery time, or delivery method, we recommend that the Customer contacts us in advance. The offer is valid while stocks last and can be adjusted or withdrawn by Velvet at any time. Velvet cannot be held liable for the unavailability of a product. If an offer has a limited validity or is subject to conditions, this will be explicitly mentioned in the offer.

Article 4: Online Purchases

Goods are selected by size and color and placed in the shopping cart. The Customer is responsible for checking their shopping cart. When the customer agrees with the contents of her shopping cart, she is directed to payment. The Customer has the choice between the following payment methods: by credit card or by debit card. Velvet is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders in which the Customer is involved. 

Article 5: Retention of Ownership

The delivered items remain the exclusive property of Velvet until full payment by the Customer. The Customer undertakes to inform third parties of Velvet's retention of ownership if necessary, e.g., to anyone who would seize the unpaid items.

Article 6: Warranty

In accordance with the law of September 21, 2004, concerning the protection of consumers in the sale of consumer goods, consumers have legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not diminish these rights. To claim the warranty, the customer must provide a proof of purchase. Customers are advised to keep the original packaging of the goods. For items purchased online and delivered to the customer's home, the customer must contact Velvet via email at webshop@velvetstore.be and return the item at their own expense. In case of a defect, the customer must inform Velvet as soon as possible. In any case, any defect must be reported within a period of 14 calendar days after its discovery by the customer. After this period, any right to repair or replacement expires. The (commercial and/or legal) warranty never applies to defects arising from accidents, negligence, falls, use of the item contrary to its intended purpose, failure to comply with the instructions or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use. Defects that manifest after a period of 6 months following the date of purchase, if applicable, delivery, are considered not to be hidden defects, unless proven otherwise by the customer.

Article 8: Sanctions for Non-Payment

Without prejudice to the exercise of other rights available to Velvet, in case of non-payment or late payment from the date of default, the customer is automatically and without notice obliged to pay an interest of 10% per year on the unpaid amount. Moreover, the customer is automatically and without notice obliged to pay a lump-sum compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice. Notwithstanding the foregoing, Velvet reserves the right to take back the items that are not (fully) paid.

Article 9: Use of Cookies

During a visit to the site, 'cookies' may be placed on the hard drive of your computer. A cookie is a text file placed by the server of a website in the browser of your computer or on your mobile device when you consult a website. Cookies cannot be used to identify individuals; a cookie can only identify a machine. Velvetstore.be uses 'first-party cookies.' 'First-party cookies' are technical cookies used by the visited site itself, with the aim of optimizing the site's functioning. For example: settings that the user made during previous visits to the site or a pre-filled form with data that the user entered during previous visits. You can set your internet browser in such a way that cookies are not accepted, that you receive a warning when a cookie is installed, or that cookies are subsequently removed from your hard drive. You can do this via your browser settings (via the help function). However, please note that certain graphic elements may not display correctly, or you may not be able to use certain applications. Article 10: Invalidity - Non-waiver

If a provision of these Conditions is declared invalid, illegal, or void, this will not affect the validity, legality, and applicability of the other provisions in any way. The failure by Velvet to enforce any of the rights listed in these Conditions at any time or to exercise any right thereof will never be considered as a waiver of such a provision and will never affect the validity of these rights.

Article 11: Amendment of Conditions

These Conditions are supplemented by other conditions explicitly referred to and the general sales conditions of Velvet. In case of contradiction, these Conditions prevail.

Article 12: Proof

The customer accepts that electronic communications and backups serve as evidence.

Article 13: Applicable Law – Disputes

Belgian law applies, excluding the provisions of private international law regarding applicable law. The courts of the consumer's place of residence have jurisdiction in case of judicial disputes. The consumer can also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
